This User Agreement ("Agreement") is made between TravAcs Welfare Foundation, a not-for-profit company incorporated under Section 8 of the Companies Act, 2013, having CIN U88900UP2024NPL203107 and its registered office at Chand Rani, Simit Ganj, Sardar Patel Ganj, Meerut – 250002, Uttar Pradesh, India ("TravAcs" or "the Foundation"), and the individual who registers to receive travel assistance ("User" or "TravAcsee" or "you").
This Agreement takes effect on registration or on confirmation of a first trip, whichever is earlier.
1. Definitions
1.1 TravAcs / the Foundation — TravAcs Welfare Foundation, the organisation that coordinates accessible travel assistance and inclusive community experiences.
1.2 User / TravAcsee — a visually impaired individual who books or receives travel assistance through TravAcs.
1.3 TravAcser — a trained sighted travel companion engaged through TravAcs to provide guided assistance, orientation, mobility support, verbal description of surroundings, and travel coordination.
1.4 Trip / Assignment — a confirmed session in which a TravAcser is matched with a User for a defined date, time, route, and purpose.
1.5 Platform — the official TravAcs website, booking forms, coordination channels, helpline numbers, and communication systems operated by the Foundation.
1.6 Official Channels — the communication and payment routes formally notified by TravAcs. Personal messaging, personal payment accounts, and informal arrangements are not Official Channels.
1.7 Third-Party Provider — any transport operator, cab service, hospital, shop, venue, institution, or vendor whose services are used during a trip but which is not controlled by TravAcs.
1.8 Dues — any amount payable by the User to TravAcs for completed trips, extra time, approved expenses, or applicable cancellation charges.
1.9 Incident — any accident, injury, medical emergency, police involvement, dispute, safeguarding concern, missing-person situation, or event that threatens the safety or dignity of any person during or arising out of a trip.
2. Purpose of Agreement
2.1 This Agreement sets out the terms on which a User receives travel assistance coordinated by TravAcs.
2.2 Its purposes are to protect the safety, dignity, and autonomy of Users, to protect TravAcsers from misuse or mistreatment, and to protect the Foundation's mission and lawful operation.
2.3 Where any TravAcs policy conflicts with this Agreement, this Agreement prevails unless the policy is expressly stated to amend it.
3. Scope of Services
3.1 TravAcs coordinates accessible travel assistance, which may include hospital and clinic visits, shopping trips, railway and metro assistance, bus, cab, and airport navigation, office and institutional visits, campus movement, recreational and community outings, and other travel-related mobility support notified by TravAcs.
3.2 Services include guided travel assistance by trained TravAcsers for essential and leisure travel, assistance with cabs, public transport, and navigation, and sighted guidance comprising verbal description of surroundings and safe navigation support.
3.3 TravAcs also organises community experiences and accessibility awareness programmes, participation in which is voluntary.
3.4 What the service is not. TravAcs does not provide medical care, nursing, domestic help, personal-attendant services, childcare, financial or legal representation, or transport as a licensed carrier. A TravAcser accompanies and guides; the User remains the decision-maker in their own affairs.
3.5 Role of the TravAcser. A TravAcser is not a domestic worker, personal servant, or personal assistant. A User shall not ask a TravAcser to perform household chores, administer medication, handle banking or investment transactions, sign documents on the User's behalf, or carry out personal errands unrelated to the confirmed trip.
3.6 TravAcs acts as a facilitator and coordinator. Third-Party Providers remain responsible for their own services, pricing, and accessibility.
4. Booking & Assignment
4.1 Eligibility. Services are intended for visually impaired individuals. TravAcs may request reasonable confirmation of eligibility and may extend assistance to other persons with disabilities where it is satisfied that it can provide safe and suitable support.
4.2 Pre-booking consultation. A User may discuss accessibility needs, route, and expectations with TravAcs before booking, and is encouraged to do so for first-time or complex trips.
4.3 Trips shall be booked only through Official Channels, giving accurate details of date, time, pick-up point, destination, purpose, and expected duration. A trip is confirmed only when TravAcs confirms it in writing or electronically, and services remain subject to TravAcser availability.
4.4 Dues clearance before a new booking. A User must clear all outstanding dues from previous trips before registering a new trip or having a new trip confirmed through TravAcs, as set out in Clause 9.
4.5 Group bookings and additional participants. Where more than one person will travel, the User shall inform TravAcs in advance so that adequate assistance can be arranged. If persons beyond the approved number join a trip, TravAcs may curtail, reassign, or cancel the trip on safety grounds, and applicable charges remain payable.
4.6 Change of meeting point. A change of pick-up point or meeting location shall be requested at least two (2) hours before the scheduled start. Later requests may be declined.
4.7 Changes to route, duration, or purpose during a trip require the TravAcser's agreement and notification to TravAcs, and may affect the applicable charge.
4.8 TravAcs will make reasonable efforts to match a User's stated preferences, including a preference for a TravAcser of a particular gender, but cannot guarantee availability or a specific individual. The assigned TravAcser's name will be shared before the trip wherever practicable.
4.9 Minor Users. Where the User is below 18 years of age, registration and each trip require documented consent from a parent or legal guardian, who shall provide emergency contact details and any instructions relevant to the child's safety. The TravAcser will follow reasonable guardian instructions unless doing so would be unsafe or unlawful, in which case safety takes precedence and TravAcs will be informed immediately.
4.10 Where a User requires support to understand or accept this Agreement, a trusted family member, guardian, or supporter may assist. Such assistance does not transfer the User's rights or decision-making.
5. Responsibilities of the User
5.1 Accurate information. Provide correct identity, contact, address, and emergency-contact details, and keep them current.
5.2 Health disclosures affecting safety. Disclose in advance any medical condition, medication, allergy, mobility limitation, seizure risk, communication need, or assistance requirement that could affect safety during the trip. TravAcs will treat this information confidentially and use it only to plan safe assistance. Non-disclosure of a material safety risk may result in a trip being paused or cancelled.
5.3 Punctuality. Be ready at the agreed time and place, and inform TravAcs promptly of any delay.
5.4 Cooperation. Follow reasonable safety instructions from the TravAcser regarding traffic, platforms, crowds, staircases, escalators, and hazards, and remain with the TravAcser during the trip.
5.5 Personal belongings. Remain responsible for money, documents, valuables, and assistive devices. A TravAcser may reasonably assist with carrying items but is not a custodian of valuables and shall not be asked to hold cash, cards, or documents except briefly and where unavoidable.
5.6 Own arrangements. Bear the cost of tickets, fares, entry fees, medical charges, and personal purchases, together with the TravAcser's reasonable travel expenses where the notified rate structure so provides.
5.7 Feedback. Provide honest feedback after a trip so that TravAcs can improve matching, training, and service quality.
6. Code of Conduct
6.1 Treat every TravAcser and member of TravAcs staff with respect, dignity, patience, and without discrimination on any ground, including gender, gender identity, sexual orientation, caste, religion, region, language, age, disability, marital status, or economic background.
6.2 Communicate courteously. Do not use abusive, demeaning, threatening, or sexually coloured language.
6.3 Do not offer or give gifts, tips, loans, or additional money to a TravAcser; TravAcsers are prohibited from accepting them.
6.4 Do not ask a TravAcser to act outside the agreed scope of the trip, or to breach any law, venue rule, or TravAcs policy.
6.5 Do not consume or be under the influence of alcohol, narcotics, or intoxicants before or during a trip, as set out in Clause 7.6.
6.6 Respect the TravAcser's time, personal boundaries, privacy, and right to pause or end a trip in an unsafe situation.
6.7 Do not require a TravAcser to enter a private residence, hotel room, or enclosed non-public space beyond what the confirmed trip reasonably requires.
7. Safeguarding, Safety & Mutual Respect
This clause is fundamental to this Agreement. Its breach is treated as the most serious category of misconduct.
7.1 Zero Tolerance. TravAcs operates a zero-tolerance policy toward sexual harassment, sexual misconduct, physical abuse, verbal abuse, intimidation, threats, discrimination, stalking, coercion, exploitation, and any comparable serious misconduct, whether by a TravAcser toward a User or by a User toward a TravAcser. Any such allegation may result in immediate suspension of services or engagement while TravAcs reviews the incident, followed by appropriate action in accordance with TravAcs policies and applicable Indian law, including the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the Bharatiya Nyaya Sanhita, 2023, the Rights of Persons with Disabilities Act, 2016, and, where a minor is involved, the Protection of Children from Sexual Offences Act, 2012. Suspension pending review is a protective measure and is not a finding of guilt.
7.2 Mutual Respect. Users and TravAcsers shall treat each other with dignity, courtesy, and respect throughout the assignment. This obligation is reciprocal and TravAcs enforces it equally against both.
7.3 Role Clarification. A TravAcser is not a domestic worker, personal servant, or personal assistant. The role is limited to travel-related companionship, orientation, mobility assistance, navigation support, and reasonable travel-related assistance as defined by TravAcs. A TravAcser may decline any request outside this role, and such a refusal is not a service failure.
7.4 Professional Boundaries. Neither party may pressure, manipulate, induce, or compel the other into any activity unrelated to the agreed travel assistance. Requests for personal favours, financial dealings, romantic or sexual attention, religious or political persuasion, or personal errands are prohibited. Personal boundaries shall be respected at all times.
7.5 Consent & Comfort. If either party expresses discomfort with any activity, request, conversation, physical contact, or situation during the trip, the other party shall stop that activity immediately and without argument. Guiding contact shall be limited to what the User consents to and prefers. Concerns about service quality or unmet expectations shall be reported to TravAcs after the trip rather than pressed during it, and TravAcs will review such feedback to improve future matching and service quality.
7.6 Intoxication Policy. Neither party may participate in a trip while intoxicated or under the influence of alcohol, narcotics, or any substance that could impair judgment or safety. If either party appears impaired, or reasonably feels unsafe because of the other's condition, the trip may be paused, cancelled, or reassigned, with safety taking priority. Where a trip is stopped on this ground, TravAcs will make reasonable arrangements for the User's safe return.
7.7 Incident Reporting. Any breach of the Code of Conduct, unsafe behaviour, harassment, abuse, threat, discrimination, or other significant incident shall be reported to TravAcs immediately, and in any case within 24 hours, wherever reasonably possible.
7.8 Retaliation Protection. No User shall face retaliation, refusal of service, or adverse treatment for making a genuine complaint, cooperating in an investigation, or reporting a safety concern in good faith. Retaliation by any person is itself a breach of this Agreement.
7.9 Emergency Escalation. In any emergency, including a medical crisis, accident, police involvement, threat to personal safety, a person going missing, or any situation where either party feels at immediate risk, emergency services shall be contacted where life or safety is at risk and the TravAcs helpline shall be contacted immediately thereafter. TravAcs will coordinate with the User's registered emergency contact.
7.10 Balanced Enforcement. These protections apply equally to Users and TravAcsers. TravAcs will apply them impartially, recognising each party's respective rights, responsibilities, and role within the TravAcs service, and recognising that Users may face heightened vulnerability while travelling.
8. Privacy, Confidentiality & Data Protection
8.1 TravAcs obligations. TravAcs collects only the personal data necessary for service delivery, safety, and statutory compliance; uses it solely for those purposes; protects it with reasonable security safeguards; and prohibits unauthorised sharing beyond essential service stakeholders. Processing is carried out in accordance with the Digital Personal Data Protection Act, 2023.
8.2 A User may request access to, correction of, or deletion of their personal data, subject to legal retention requirements, by writing to support@travacs.in.
8.3 User obligations. A User shall not disclose a TravAcser's personal information, including phone number, address, family details, or any information learned during a trip, to third parties, or publish it online, without that TravAcser's written consent.
8.4 Digital conduct. A User shall not photograph, film, audio-record, live-stream, or publish content identifying a TravAcser without their prior, specific, informed consent and without TravAcs approval. Consent for one purpose is not consent for any other purpose.
8.5 A User shall not disclose confidential TravAcs information, internal processes, or training materials shared for the purpose of receiving services.
8.6 Clauses 8.3 to 8.5 survive termination of this Agreement.
9. Payment Policy
9.1 No pre-payment at booking. TravAcs does not require full payment in advance to confirm a trip. Confirmation depends on TravAcser availability and on the User's dues status under Clause 9.5.
9.2 Transparent charges. The applicable contribution or service charge, the rate structure for single and multiple users, and any reimbursable travel expenses will be communicated to the User before the trip is confirmed, in an accessible format.
9.3 Payment after the trip. Payment becomes due after the trip is completed. A statement or receipt will be issued through Official Channels, and payment shall be made within seven (7) days of the trip unless a different timeline is agreed in writing.
9.4 Extra time. Time used beyond the booked duration is charged at the notified rate, recorded at the end of the trip, and added to the User's dues for that trip.
9.5 Dues clearance before a new booking. A User must clear all outstanding dues from previous trips before registering a new trip or having a new trip confirmed through TravAcs. TravAcs may decline or hold a booking request while dues remain unpaid.
9.6 Overdue payments. Dues unpaid beyond seven (7) days are treated as overdue. TravAcs will issue a reminder through Official Channels and allow a further period of seven (7) days before any restriction takes effect. Overdue dues may attract a late-payment charge at the rate notified in the official rate structure.
9.7 Temporary suspension for unpaid dues. If dues remain unpaid beyond the reminder period, the User's account may be temporarily suspended and no new trips confirmed until the dues are cleared. Suspension for unpaid dues is a temporary administrative measure, not a permanent exclusion, and access is restored promptly once payment is received and confirmed.
9.8 Genuine hardship. A User facing genuine financial difficulty may write to TravAcs before the due date. As a Section 8 not-for-profit, TravAcs may at its discretion allow instalments, an extension, a waiver, or subsidised assistance. Requests are considered confidentially and no User will be penalised for making one.
9.9 Official payment channels only. Payments shall be made only through the official TravAcs channels notified in writing. Cash or transfers to a TravAcser's personal account, or to any unofficial account, are prohibited, are not recognised as payment to TravAcs, and remain at the User's own risk.
9.10 No tips or gifts. A User shall not pay tips, gifts, or additional money to a TravAcser. TravAcsers are prohibited from accepting them.
9.11 Refunds. Where TravAcs fails to provide a confirmed service, any amount already paid for that trip is refunded in full or credited against future dues, at the User's option. No refund is payable for a no-show, except in exceptional circumstances at the discretion of TravAcs.
9.12 Emergency safeguard. No User will be refused assistance in a genuine medical or safety emergency solely because of unpaid dues.
10. Cancellation & Attendance
10.1 A User may cancel a confirmed trip at least six (6) hours in advance without charge. In a genuine emergency, cancellation may be made at any time, with notice given as soon as possible.
10.2 Cancellation with less than six hours' notice, or a no-show, may attract a cancellation charge as notified, which is added to the User's dues under Clause 9.
10.3 Where a TravAcser has waited more than thirty (30) minutes beyond the agreed time without contact from the User, the trip may be treated as a no-show.
10.4 TravAcs may cancel or reassign a trip for safety reasons, TravAcser unavailability, or force majeure. It will inform the User at the earliest and will attempt an alternative arrangement.
10.5 Repeated late cancellations or no-shows without valid reason may lead to temporary suspension of booking privileges.
11. Safety & Emergency Procedures
11.1 Safety takes priority over convenience, schedule, or preference where the two conflict.
11.2 A User shall register at least one emergency contact and keep it current.
11.3 Immediate contact with TravAcs is required in cases of:
- accidents or injury to either party;
- police, legal, or regulatory involvement;
- medical emergencies;
- the User or TravAcser becoming separated or going missing;
- theft, loss, or damage to property;
- harassment, threats, or safeguarding concerns;
- crowd trouble, protest, or transport disruption;
- any other unsafe situation.
11.4 Emergency cooperation. A User shall cooperate with reasonable emergency instructions from the TravAcser and from TravAcs, and consents to TravAcs contacting their registered emergency contact, a hospital, or the police where the User's life, health, or safety appears to be at immediate risk.
11.5 Emergency decisions. Where immediate safety requires it and TravAcs cannot be reached in time, a TravAcser may take reasonable and proportionate action, including seeking medical help, moving the User to a safe location, arranging alternative transport, or contacting the police or the User's emergency contact, and shall inform TravAcs and the User as soon as possible. This does not override the User's right to make decisions about their own body and treatment wherever they are able to do so.
11.6 Medical costs and insurance. TravAcs will assist in arranging or locating emergency care but is not liable for the cost of medical treatment. Users are strongly encouraged to maintain personal travel or health insurance.
11.7 A User shall comply with applicable health regulations and public-health protocols in force at the time of travel.
11.8 A User shall not direct a trip into a location or activity that is unlawful, unsafe, or reasonably refused by the TravAcser.
12. Prohibited Conduct
A User shall not:
12.1 Privately hire or contact a TravAcser outside the official TravAcs Platform, or attempt to arrange assistance directly with a TravAcser introduced through TravAcs.
12.2 Bypass or attempt to bypass TravAcs systems, or make or receive payments outside Official Channels. Doing so may result in suspension or termination of service, recovery of amounts due, and legal action, and removes the User from the protection of the TravAcs safety, verification, and grievance systems.
12.3 Harass, abuse, intimidate, stalk, threaten, coerce, or exploit a TravAcser or any member of TravAcs staff, in person or through any medium, during or after a trip.
12.4 Make unwanted romantic or sexual advances, comments, or contact toward a TravAcser.
12.5 Demand domestic, personal-attendant, medical, financial, or other services outside the defined scope.
12.6 Consume or be under the influence of alcohol, narcotics, or intoxicants during a trip.
12.7 Record, photograph, or publish a TravAcser without consent, or share a TravAcser's personal data.
12.8 Provide false identity, health, eligibility, or booking information, or use the service on behalf of an undisclosed third party.
12.9 Misuse the TravAcs name, logo, or materials, or claim to represent or be authorised by TravAcs.
12.10 Ask a TravAcser to carry weapons, prohibited substances, or unlawful items, or to participate in any unlawful activity.
12.11 Make knowingly false or malicious complaints against a TravAcser or against TravAcs staff.
13. Incident Reporting & Grievance Redressal
13.1 Incidents shall be reported to TravAcs immediately, and in any case within 24 hours, through Official Channels. TravAcs accepts complaints by telephone, email, or any accessible format, and will assist a User in recording a complaint where required.
13.2 TravAcs will acknowledge a complaint within a reasonable period, conduct a fair and confidential review, give both parties an opportunity to be heard before any final adverse decision, and communicate the outcome.
13.3 Complaints of sexual harassment will be referred to the appropriate committee or authority under applicable law. Nothing in this Agreement limits any person's right to approach the police or a court.
13.4 A User shall cooperate honestly with any review and shall not destroy, alter, or conceal evidence.
13.5 Service-quality concerns should be raised after the trip and will be used to improve matching, training, and service quality.
14. Suspension & Termination
14.1 TravAcs may suspend a User's access with immediate effect pending review of any safeguarding allegation or serious Incident, or temporarily under Clause 9.7 where dues remain unpaid.
14.2 TravAcs may terminate service for serious or repeated breach of this Agreement, harassment or abuse of a TravAcser, fraud or misrepresentation, persistent non-payment, or unlawful conduct.
14.3 A User may stop using the service at any time by written notice, after clearing outstanding dues.
14.4 Termination does not affect dues already payable or liabilities already incurred.
14.5 Clauses 8, 9 (to the extent of unpaid dues), 15, 17, 20, and 21 survive termination of this Agreement.
14.6 A User whose access has been terminated may request a review after six months. TravAcs will consider such requests fairly, except in cases involving serious safeguarding breaches.
15. Intellectual Property & Brand Usage
15.1 The TravAcs name, logo, branding, certificates, identity cards, photographs, and materials remain the exclusive property of TravAcs Welfare Foundation.
15.2 A User shall not use, reproduce, alter, or display any of the above, or represent themselves as an agent, partner, or spokesperson of TravAcs, without prior written permission.
15.3 A User may share their own experience publicly, provided they do not misuse TravAcs branding and do not identify a TravAcser without consent.
15.4 Where a User voluntarily provides a photograph, testimonial, or story, TravAcs may use it for awareness purposes only with the User's specific written consent, which may be withdrawn at any time in respect of future use.
16. Relationship of the Parties
16.1 TravAcsers are independent trained companions or volunteers engaged by TravAcs and are not employees of the Foundation unless separately contracted in writing.
16.2 No TravAcser is an employee, agent, or servant of the User. This Agreement governs service engagement only and creates no employment, partnership, or agency between the User and any TravAcser.
16.3 A User shall not treat, direct, or describe a TravAcser as domestic help or personal staff.
17. Limitation of Liability
17.1 TravAcs is not liable for injuries, accidents, delays, losses, or third-party acts encountered during a trip, except to the extent caused by the Foundation's own negligence or wilful default.
17.2 TravAcs is not responsible for the acts, omissions, delays, accessibility failures, pricing, or service quality of Third-Party Providers.
17.3 TravAcs is not liable for loss of or damage to a User's money, documents, valuables, or personal belongings, which remain the User's responsibility under Clause 5.5.
17.4 TravAcs is not liable for the outcome of medical, legal, financial, or personal decisions taken by the User during or after a trip, nor for the cost of medical treatment.
17.5 TravAcs is not liable for anything arising from arrangements made outside Official Channels in breach of Clause 12.1 or 12.2.
17.6 Where liability is established, it shall not exceed the amount paid or payable by the User for the trip concerned, except where a higher liability cannot be excluded under Indian law.
17.7 Nothing in this clause limits liability for death or personal injury caused by the Foundation's negligence, or any other liability that cannot lawfully be limited or excluded.
18. Force Majeure
18.1 TravAcs shall not be liable for delay, disruption, or failure to provide services caused by events beyond its reasonable control, including natural disasters, floods, earthquakes, epidemics or pandemics, strikes and bandhs, transport shutdowns or cancellations, government orders or restrictions, curfews, civil unrest, war, fire, or failure of public infrastructure or telecommunications.
18.2 Affected trips may be postponed, reassigned, or cancelled without penalty to either party, and no cancellation charge shall apply.
18.3 TravAcs will inform the User as soon as practicable and, where a trip is already in progress, will prioritise the User's safe return.
19. Legal Compliance
19.1 A User shall comply with all applicable Indian laws, transport and venue rules, public-health protocols, and TravAcs policies while receiving services.
19.2 A User shall not use the service for any unlawful purpose or to facilitate any unlawful act.
19.3 A User shall promptly report to TravAcs any incident involving law enforcement, accidents, or disputes arising during a trip.
19.4 TravAcs may verify a User's identity and, where required by law, share information with lawful authorities.
20. Dispute Resolution
20.1 The parties shall first attempt to resolve any dispute amicably through discussion and through the grievance process in Clause 13.
20.2 Failing resolution within thirty (30) days, the dispute shall be referred to mediation and, if still unresolved, to arbitration by a sole arbitrator appointed by TravAcs with the User's consent, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Meerut, Uttar Pradesh, and the language shall be English. Proceedings shall be conducted in a manner accessible to the User, including remote participation where reasonable.
20.3 This clause does not bar either party from seeking urgent interim relief from a competent court, or from pursuing any criminal, consumer, or statutory remedy available under Indian law.
21. Governing Law & Jurisdiction
This Agreement is governed by the laws of India. Subject to Clause 20 and to any non-excludable statutory right of the User, the courts at Meerut, Uttar Pradesh, shall have jurisdiction over any dispute arising out of or in connection with this Agreement.
22. Amendments & Notices
22.1 TravAcs may amend this Agreement or its policies, with notice given by email, through Official Channels, or by publication on www.travacs.in, in an accessible format.
22.2 Amendments take effect from the notified date. Continuing to book trips after that date constitutes acceptance of the amended terms.
22.3 Notices to TravAcs shall be sent to support@travacs.in or to the registered office. Notices to the User shall be sent to the contact details on record, which the User shall keep current.
22.4 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions continue in full force.
23. Acceptance & Acknowledgement
By signing or digitally accepting this Agreement, and by booking and using TravAcs services, the User confirms that its terms have been read, or read out and explained in an accessible format, and understood, and agrees to be bound by them and by the policies of TravAcs Welfare Foundation.
