This TravAcser Agreement ("Agreement") is made between TravAcs Welfare Foundation, a not-for-profit company incorporated under Section 8 of the Companies Act, 2013, having CIN U88900UP2024NPL203107 and its registered office at Chand Rani, Simit Ganj, Sardar Patel Ganj, Meerut – 250002, Uttar Pradesh, India ("TravAcs" or "the Foundation"), and the individual who registers with TravAcs as a trained travel companion ("TravAcser" or "you").
This Agreement takes effect on the date the TravAcser accepts it, whether by signature, by digital acceptance, or by accepting a first Assignment through official TravAcs channels.
1. Definitions
1.1 TravAcs / the Foundation — TravAcs Welfare Foundation, the organisation that coordinates accessible travel assistance and inclusive community experiences.
1.2 TravAcser — a trained sighted travel companion engaged through TravAcs to provide guided assistance, orientation, mobility support, verbal description of surroundings, and travel coordination.
1.3 TravAcsee / User — a visually impaired individual who books or receives travel assistance through TravAcs.
1.4 Assignment / Trip — a confirmed session in which a TravAcser is matched with a User for a defined date, time, route, and purpose.
1.5 Platform — the official TravAcs website, booking forms, coordination channels, helpline numbers, and communication systems operated by the Foundation.
1.6 Official Channels — the communication and payment routes formally notified by TravAcs. Personal messaging, personal payment accounts, and informal arrangements are not Official Channels.
1.7 Third-Party Provider — any transport operator, cab service, hospital, shop, venue, institution, or vendor whose services are used during an Assignment but which is not controlled by TravAcs.
1.8 Code of Conduct — the standards set out in Clauses 6, 7, and 12, together with any policy TravAcs issues in writing from time to time.
1.9 Incident — any accident, injury, medical emergency, police involvement, dispute, safeguarding concern, missing-person situation, or event that threatens the safety or dignity of any person during or arising out of an Assignment.
2. Purpose of Agreement
2.1 This Agreement sets out the terms on which a TravAcser provides guided travel assistance to Users through TravAcs.
2.2 Its purposes are to protect the safety and dignity of Users, to protect the safety, dignity, and interests of TravAcsers, and to protect the Foundation's mission, name, and lawful operation.
2.3 Where any TravAcs policy conflicts with this Agreement, this Agreement prevails unless the policy is expressly stated to amend it.
3. Scope of Services
3.1 A TravAcser provides accessible travel assistance, which may include hospital and clinic visits, shopping trips, railway and metro assistance, bus, cab, and airport navigation, office and institutional visits, campus movement, recreational and community outings, and other travel-related mobility support notified by TravAcs.
3.2 Assistance includes sighted guidance, verbal description of surroundings, and safe navigation support, delivered using the safe-guiding techniques, communication methods, and etiquette taught during TravAcs training.
3.3 A TravAcser may also support community experiences and accessibility awareness activities organised by TravAcs, where separately agreed.
3.4 Limits of role. A TravAcser is not a domestic worker, personal servant, personal assistant, nurse, caregiver, financial agent, or legal representative. A TravAcser shall not administer medication, perform medical or nursing procedures, handle a User's banking or investment transactions, sign documents on a User's behalf, or perform household chores.
3.5 A TravAcser shall not accept tasks outside the scope of the confirmed Assignment. Where a User requests such a task, the TravAcser shall politely decline and report the request to TravAcs.
4. Booking & Assignment
4.1 Assignments are offered through Official Channels. A TravAcser is free to accept or decline any Assignment before confirmation, and no reason need be given.
4.2 Once accepted, an Assignment is a commitment. The TravAcser shall attend at the agreed time and place and in the agreed manner.
4.3 The TravAcser shall confirm the User's identity and the agreed itinerary at the start of the Assignment, and shall notify TravAcs of any material change to the route, duration, or purpose.
4.4 Approved participants. A TravAcser is assigned to the number of Users approved by TravAcs. If additional or unapproved persons join a trip, the TravAcser shall inform TravAcs immediately; TravAcs may curtail, reassign, or cancel the trip on safety grounds.
4.5 Change of meeting point. A change of pick-up point or meeting location requested less than two (2) hours before the scheduled start may be declined, and the TravAcser shall report any such request to TravAcs.
4.6 Minor Users. Where the User is below 18 years of age, the Assignment shall proceed only with documented consent from a parent or legal guardian. The TravAcser shall follow reasonable guardian instructions, shall not deviate from the approved itinerary, and shall not be alone with the minor in a private, enclosed, or non-public setting except where unavoidable for safety. Any concern shall be reported to TravAcs immediately.
4.7 A TravAcser shall not sub-contract, delegate, or transfer an Assignment to any other person.
5. Responsibilities of the TravAcser
5.1 Professionalism. Maintain a high standard of professionalism, punctuality, empathy, and safety awareness throughout every Assignment.
5.2 Identification. Carry official TravAcs identification whenever issued, and present it on request by the User, the User's family, or any lawful authority.
5.3 Preparedness. Carry a charged mobile phone with the TravAcs helpline saved, and a basic first-aid kit on long-distance or high-risk trips.
5.4 Health and fitness. Be physically fit and mentally alert on duty, and disclose to TravAcs in advance any health condition, medication, injury, or circumstance that may affect the safety or quality of assistance.
5.5 Training and performance. Attend onboarding and refresher training conducted by TravAcs, and comply with performance reviews based on User feedback and adherence to guidelines.
5.6 Communication. Describe surroundings, obstacles, and routes clearly; ask the User's preferred guiding method; and never make decisions on the User's behalf except in an emergency under Clause 11.
5.7 Accurate records. Report Assignment start and end times, extra time, distances, and expenses truthfully.
5.8 Property. Handle the User's belongings, mobility aids, documents, and assistive devices with care; use them only as directed; and never retain, borrow, pledge, or dispose of any User property. Loss or damage shall be reported to TravAcs immediately.
6. Code of Conduct
6.1 Treat every User with respect, dignity, patience, and without discrimination on any ground, including disability, gender, gender identity, sexual orientation, caste, religion, region, language, age, marital status, or economic background.
6.2 Communicate courteously. Do not use abusive, demeaning, patronising, or sexually coloured language.
6.3 Do not consume or be under the influence of alcohol, narcotics, or intoxicants before or during an Assignment, as set out in Clause 7.6.
6.4 Do not solicit, request, or accept gifts, tips, loans, donations, or additional money from a User or a User's family.
6.5 Do not discuss a User's disability, personal circumstances, or private information with third parties.
6.6 Respect the User's autonomy, choices, pace, and right to refuse assistance at any moment.
6.7 Dress and conduct yourself appropriately for the destination, including places of worship, hospitals, and institutions.
7. Safeguarding, Safety & Mutual Respect
This clause is fundamental to this Agreement. Its breach is treated as the most serious category of misconduct.
7.1 Zero Tolerance. TravAcs operates a zero-tolerance policy toward sexual harassment, sexual misconduct, physical abuse, verbal abuse, intimidation, threats, discrimination, stalking, coercion, exploitation, and any comparable serious misconduct. Any allegation of such conduct may result in immediate suspension from Assignments while TravAcs reviews the incident, followed by appropriate action in accordance with TravAcs policies and applicable Indian law, including the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the Bharatiya Nyaya Sanhita, 2023, the Rights of Persons with Disabilities Act, 2016, and, where a minor is involved, the Protection of Children from Sexual Offences Act, 2012. Suspension pending review is a protective measure and is not a finding of guilt.
7.2 Mutual Respect. TravAcsers and Users shall treat each other with dignity, courtesy, and respect throughout the assignment. This obligation is reciprocal and TravAcs enforces it equally against both.
7.3 Role Clarification. A TravAcser is not a domestic worker, personal servant, or personal assistant. The role is limited to travel-related companionship, orientation, mobility assistance, navigation support, and reasonable travel-related assistance as defined by TravAcs. A TravAcser may decline any request outside this role without penalty and shall report it to TravAcs.
7.4 Professional Boundaries. Neither party may pressure, manipulate, induce, or compel the other into any activity unrelated to the agreed travel assistance. Requests for personal favours, financial dealings, romantic or sexual attention, religious or political persuasion, or personal errands are prohibited. Personal boundaries shall be respected at all times.
7.5 Consent & Comfort. If either party expresses discomfort with any activity, request, conversation, physical contact, or situation during the trip, the other party shall stop that activity immediately and without argument. Guiding contact shall be limited to what is necessary and consented to. Concerns about service quality or unmet expectations shall be reported to TravAcs after the trip rather than pressed during it, and TravAcs will review such feedback to improve future matching and service quality.
7.6 Intoxication Policy. Neither party may participate in a trip while intoxicated or under the influence of alcohol, narcotics, or any substance that could impair judgment or safety. If a TravAcser reasonably believes the User is impaired, or feels unsafe because of the User's condition, the TravAcser may pause the Assignment, move to a safe public place, and contact TravAcs, which may cancel or reassign the Assignment. No TravAcser shall be penalised for acting reasonably and in good faith under this clause.
7.7 Incident Reporting. Any breach of the Code of Conduct, unsafe behaviour, harassment, abuse, threat, discrimination, or other significant incident shall be reported to TravAcs immediately, and in any case within 24 hours, wherever reasonably possible.
7.8 Retaliation Protection. No TravAcser shall face retaliation, blacklisting, reduction of Assignments, or withholding of dues for making a genuine complaint, cooperating in an investigation, or reporting a safety concern in good faith. Retaliation by any person is itself a breach of this Agreement.
7.9 Emergency Escalation. In any emergency, including a medical crisis, accident, police involvement, threat to personal safety, a User going missing, or any situation where either party feels at immediate risk, the TravAcser shall contact emergency services where life or safety is at risk and shall contact the TravAcs helpline immediately thereafter.
7.10 Balanced Enforcement. These protections apply equally to Users and TravAcsers. TravAcs will apply them impartially, recognising each party's respective rights, responsibilities, and role within the TravAcs service, and recognising that Users may face heightened vulnerability while travelling.
8. Privacy, Confidentiality & Data Protection
8.1 A TravAcser shall not disclose any personal, medical, financial, or sensitive information concerning a User, a User's family, or TravAcs operations to any third party without written consent, except where disclosure is required by law or is necessary to protect life or safety.
8.2 This confidentiality obligation survives termination of this Agreement and continues indefinitely.
8.3 Digital conduct. A TravAcser shall not photograph, film, audio-record, live-stream, or screenshot a User, or post any content identifying a User, without the User's prior, specific, informed, and freely given consent and without TravAcs approval. Consent for one purpose is not consent for any other purpose.
8.4 A TravAcser shall not store User contact details beyond what an Assignment requires, and shall delete such details on request or on termination.
8.5 Data protection. TravAcs collects only the data necessary for service delivery, safety, and statutory compliance; uses it solely for those purposes; protects it with reasonable security safeguards; and prohibits unauthorised sharing. Processing is carried out in accordance with the Digital Personal Data Protection Act, 2023. A TravAcser processing User data on behalf of TravAcs shall do so strictly on instruction.
9. Compensation, Reimbursements & Payouts
9.1 A TravAcser receives honorarium or travel compensation in accordance with the official TravAcs payout structure notified from time to time.
9.2 All payments are made through authorised TravAcs channels only, to the bank or payment details registered by the TravAcser.
9.3 A TravAcser shall not collect cash or any payment directly from a User, and shall not request advance payment from a User under any circumstances. Users pay TravAcs, not the TravAcser.
9.4 Approved travel and incidental expenses are reimbursed on submission of proof within the timeline notified by TravAcs.
9.5 Payouts are processed on the notified cycle. TravAcs may withhold a payout only where an Incident, investigation, or documented dispute is pending, and shall release it promptly on conclusion if no breach is established.
9.6 Deductions may be made only for amounts owed to TravAcs, for advances, or as required by law, and shall be communicated in writing.
9.7 A TravAcser's payout is not contingent on recovery of dues from a User, except where the TravAcser has failed to report extra time or expenses accurately.
10. Cancellation & Attendance
10.1 Once an Assignment is accepted, cancellation shall be made at least six (6) hours in advance, except in a genuine emergency.
10.2 Emergency cancellations shall be notified to TravAcs at the earliest possible moment so that reassignment can be attempted.
10.3 Repeated last-minute cancellations, late arrivals, or no-shows without valid reason may lead to reduced Assignments, retraining, or suspension.
10.4 A TravAcser shall never abandon a User mid-trip. If an Assignment cannot be continued, the TravAcser shall remain with the User in a safe place and contact TravAcs until a handover or safe return is arranged.
11. Safety & Emergency Procedures
11.1 A TravAcser shall prioritise safety over convenience, schedule, or User preference where the two conflict.
11.2 Immediate contact with TravAcs is mandatory in cases of:
- accidents or injury to either party;
- police, legal, or regulatory involvement;
- medical emergencies;
- a User going missing or becoming separated;
- theft, loss, or damage to property;
- harassment, threats, or safeguarding concerns;
- crowd trouble, protest, or transport disruption;
- any other unsafe situation.
11.3 Emergency Decision Clause. Where immediate safety requires it and TravAcs cannot be reached in time, a TravAcser may take reasonable and proportionate action, including seeking medical help, moving the User to a safe location, arranging alternative transport, or contacting the police or the User's registered emergency contact, and shall inform TravAcs as soon as possible thereafter. Reasonable action taken in good faith under this clause shall not be treated as a breach of this Agreement.
11.4 A TravAcser shall keep the TravAcs helpline and the User's registered emergency contact accessible during every Assignment.
11.5 A TravAcser shall not leave a User unattended in an unfamiliar, unsafe, or inaccessible location.
11.6 TravAcs will assist in arranging or locating emergency care where required but does not bear the cost of a User's or a TravAcser's medical treatment unless it expressly agrees otherwise in writing.
12. Prohibited Conduct
A TravAcser shall not:
12.1 Solicit Users for assistance outside the TravAcs Platform, or accept private engagements from a User introduced through TravAcs.
12.2 Bypass or attempt to bypass TravAcs systems for private arrangements. Doing so may result in blacklisting, forfeiture of pending dues, and legal action.
12.3 Request or accept gifts, tips, loans, or additional money from Users or their families.
12.4 Share, sell, or misuse User contact details or personal data.
12.5 Consume or be under the influence of alcohol, narcotics, or intoxicants on duty.
12.6 Engage in any romantic, sexual, or financially exploitative conduct toward a User.
12.7 Conflict of interest. Use the TravAcs name, logo, identity card, training materials, or User network to promote personal business, another organisation, a political or religious cause, or any commercial product or service.
12.8 Make public statements, media comments, or social media posts on behalf of TravAcs without written authorisation.
12.9 Discriminate against, refuse, or provide inferior assistance to any User on a protected ground.
12.10 Carry weapons, prohibited substances, or unlawful items on an Assignment.
12.11 Falsify attendance, timings, expenses, or Incident records.
13. Incident Reporting & Grievance Redressal
13.1 Incidents shall be reported to TravAcs immediately, and in any case within 24 hours, through Official Channels.
13.2 A written report shall follow within 48 hours where TravAcs requests one.
13.3 TravAcs will acknowledge a complaint within a reasonable period, conduct a fair and confidential review, give the TravAcser an opportunity to be heard before any final adverse decision, and communicate the outcome.
13.4 Complaints of sexual harassment will be referred to the appropriate committee or authority under applicable law. Nothing in this Agreement limits any person's right to approach the police or a court.
13.5 A TravAcser shall cooperate honestly with any review and shall not destroy, alter, or conceal evidence.
13.6 Suppression, delayed reporting, or falsification of an Incident is independently a serious breach of this Agreement.
14. Suspension & Termination
14.1 TravAcs may suspend a TravAcser with immediate effect pending review of any safeguarding allegation or serious Incident.
14.2 TravAcs may terminate engagement for breach of this Agreement, misconduct, non-performance, falsification of records, or conduct that damages the Foundation's reputation or mission.
14.3 A TravAcser may withdraw voluntarily by giving reasonable written notice through Official Channels, after completing accepted Assignments and clearing pending tasks or dues.
14.4 On termination, the TravAcser shall return TravAcs identification, materials, and any User property, and shall delete User data held.
14.5 Clauses 8, 15, 17, 20, and 21 survive termination of this Agreement.
15. Intellectual Property & Brand Usage
15.1 The TravAcs name, logo, branding, training content, certificates, identity cards, photographs, and materials remain the exclusive property of TravAcs Welfare Foundation.
15.2 A TravAcser shall not use, reproduce, alter, or display any of the above without prior written permission, and shall not represent themselves as an officer, spokesperson, or agent of TravAcs beyond the role of TravAcser.
15.3 Certificates and training credentials may be used for genuine personal or academic representation of volunteer experience only, without alteration.
15.4 On termination, all rights to use TravAcs branding cease immediately.
16. Relationship of the Parties
16.1 A TravAcser is engaged as an independent trained companion or volunteer and is not an employee of TravAcs Welfare Foundation unless a separate written employment contract is executed.
16.2 This Agreement governs service engagement only and creates no partnership, agency, or joint venture between the parties.
16.3 A TravAcser is responsible for their own tax obligations on any honorarium received, in accordance with law.
17. Limitation of Liability & Indemnity
17.1 TravAcs is not liable for injuries, accidents, losses, or third-party acts encountered during an Assignment, except to the extent caused by the Foundation's own negligence or wilful default.
17.2 A TravAcser is responsible for their personal conduct and personal safety during Assignments.
17.3 TravAcs is not responsible for the acts, omissions, delays, or service failures of Third-Party Providers.
17.4 A TravAcser shall indemnify TravAcs against loss or claim arising from their wilful misconduct, gross negligence, or breach of this Agreement.
17.5 Nothing in this clause limits liability that cannot be limited or excluded under Indian law.
17.6 TravAcsers are encouraged to maintain personal accident or health insurance.
18. Force Majeure
18.1 Neither party shall be liable for delay or failure in performance caused by events beyond reasonable control, including natural disasters, floods, earthquakes, epidemics or pandemics, strikes and bandhs, transport shutdowns or cancellations, government orders or restrictions, curfews, civil unrest, war, fire, or failure of public infrastructure or telecommunications.
18.2 Affected Assignments may be postponed, reassigned, or cancelled without penalty to either party.
18.3 The affected party shall notify the other as soon as practicable, and both shall act reasonably to protect User safety.
19. Legal Compliance
19.1 A TravAcser shall comply with all applicable Indian laws, local regulations, transport and venue rules, public-health protocols, and TravAcs policies while on duty.
19.2 A TravAcser shall promptly disclose any criminal proceeding, conviction, or legal restriction that could affect their suitability for the role.
19.3 A TravAcser consents to reasonable verification checks conducted lawfully by TravAcs, including identity and background verification.
19.4 A TravAcser shall report any incident involving law enforcement, accidents, or disputes during service immediately to TravAcs.
20. Dispute Resolution
20.1 The parties shall first attempt to resolve any dispute amicably through discussion.
20.2 Failing resolution within thirty (30) days, the dispute shall be referred to mediation and, if still unresolved, to arbitration by a sole arbitrator appointed by TravAcs with the TravAcser's consent, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Meerut, Uttar Pradesh, and the language shall be English.
20.3 This clause does not bar either party from seeking urgent interim relief from a competent court, or from pursuing any criminal or statutory remedy available under Indian law.
21. Governing Law & Jurisdiction
This Agreement is governed by the laws of India. Subject to Clause 20, the courts at Meerut, Uttar Pradesh, shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement.
22. Amendments & Notices
22.1 TravAcs may amend this Agreement or its policies, with notice given by email or through Official Channels.
22.2 Amendments take effect from the notified date. Continuing to accept Assignments after that date constitutes acceptance of the amended terms.
22.3 Notices to TravAcs shall be sent to support@travacs.in or to the registered office. Notices to the TravAcser shall be sent to the contact details on record, which the TravAcser shall keep current.
22.4 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions continue in full force.
23. Acceptance & Acknowledgement
By signing or digitally accepting this Agreement, the TravAcser confirms having read and understood its terms and agrees to be bound by them and by the policies of TravAcs Welfare Foundation.
